TERMS & CONDITIONS

The terms and conditions are provided to protect Brawview Motorhomes and you the hirer. We offer motorhome hire strictly in accordance with the following terms and conditions which should be read, understood and accepted. When signed the hirer (you) agree legally with the details within this document.

Brawview Motorhomes is a trading name of Mark Sey Enterprises Ltd., 4 McKenzie Square, St Andrews, Fife, KY16 8ND

BOOKING CONFIRMATION DEPOSIT AND PAYMENT

At the time of booking a £250 deposit must be received by Brawview Motorhomes within 1 day of booking. This deposit is non-refundable. When received and booking accepted a confirmation and receipt will be sent by email to you. The outstanding balance must be paid 4 weeks before the hire commences. A reminder will be sent out by email from Brawview Motorhomes. A security indemnity of £1000 will be taken on collection of the motorhome. Provided that the motorhome is returned without damages, breakages or shortages and in a clean condition this indemnity will normally be returned within 10 days of the vehicles return.

CANCELLATION

In the unlikely event you should need to cancel, firstly contact Brawview Motorhomes. If your cancellation is more than 4 weeks prior to the date of hire, there will be nothing more to pay. If the cancellation is between 4 weeks and 2 weeks of the hire 50% of the total will be charged. If less than 2 weeks the full amount will be charged.

Please remember the initial deposit of £250 is non-refundable.

COLLECTION AND DELIVERY TIMES

Collection from Brawview Motorhomes will normally be between 3pm and 5pm. Return on the last day of hire by 10am. Collection and return to rail stations (Leuchars or Dundee) or Edinburgh Airport times will be agreed with Brawview Motorhomes at the time of booking and will be subject to an additional fee.

Please allow 1 hour for the handover of the vehicle on collection. This enables us to familiarise you with the vehicle so that you will enjoy your motorhome hire to the full. On return, please allow 1 hour to allow us to carry out a post hire inspection and for you to remove your belongings. The motorhome must be in the same clean condition as you received it on handover, with the toilet cassette empty and washed out, waste-water emptied and a full tank of fuel. Charges will apply if any of the above are not carried out (see Returning the Vehicle section).

LATE RETURNS

Late returns have a major impact on the next hire.  A charge equivalent to an extra days’ rental will be enforced if the vehicle is returned late without prior authorisation.  Please be aware that you are only insured up to the agreed time of return, thereafter the insurance will be invalidated. There are no refunds on motorhomes returned early. Please bear in mind vehicles need to be cleaned, maintained & ready for collection for the next hirer. Please leave enough time to re-fuel before handover.

INSURANCE

Comprehensive insurance is available for all drivers as part of the hire agreement.

FORCED CANCELLATION BY BRAWVIEW MOTORHOMES

In the unlikely event that an unforeseen situation occurs, which is unavoidable, whereby your motorhome is unavailable, and no replacement can be agreed or sourced, all monies will be returned in full. However, Brawview Motorhomes will not be held liable for any additional costs or compensation. Brawview Motorhomes liability will be strictly limited to the return of all monies paid in full.

YOUR RESPONSIBILITIES

  • You must ensure the vehicle is locked when not in use and the key is secure
  • Correct fuel must be used
  • Avoid damage by low bridges, branches etc
  • You must not sell or dispose of the vehicle or any part thereof
  • You must not allow any work to be carried out on the vehicle without permission of Brawview Motorhomes. If permission is granted refunds will only be made against receipts for the work
  • You must not give anyone legal rights over the vehicle
  • You must not use the vehicle if under the influence of alcohol or drugs
  • You must not overload the vehicle
  • You must not carry more than 5 people in the vehicle

CHARGES

Charges are based on Brawview Motorhomes’ price list at the time of booking. You will be charged for:

The rental and any other charges we work out according to this agreement.

A charge for loss or damage to the motorhome including that caused by neglect, misuse, accident or not your fault, subject to the cover provided by the hire insurance.

SECURITY/DAMAGE BOND (referred to on page 1)

A security/indemnity deposit of £1000 is payable on collection of the motorhome. Damage to the motorhome (externally or internally) will be deducted from this deposit to cover the costs of repairs/fitments or the insurance claim excess as described in these terms and conditions. You agree that the deposit is payable in full as a condition of hire, payment to be made to Brawview Motorhomes by card at time of collection of the vehicle. The deposit will only be retained by Brawview Motorhomes if, on return of the hire vehicle, it is found that damage or losses have been incurred. In such an event, the deposit is retained by Brawview Motorhomes who will place it in its account until the claim or dispute is settled. The agreed amount for the repair/s or item/s will be kept by Brawview Motorhomes with the balance of the deposit (if any) refunded to you. The deposit is refunded within 10 working days when the vehicle is returned damage. You accept that Brawview Motorhomes is entitled to charge any credit or debit card used by you during the hire transaction for payment of the deposit or any other outstanding charges as per the terms and conditions of the hire.

WHAT TO DO IF YOU HAVE A BREAKDOWN

No responsibility can be accepted by Brawview Motorhomes for any loss or damage or expense which occurs as a result of any defect or breakdown unless it is due to a proven reason of the operators failure to adequately maintain the motorhome in a fit state and condition. If you do breakdown you should contact the breakdown service that covers the vehicle and inform Brawview Motorhomes immediately – details are in the vehicle.

WHAT TO DO IF YOU HAVE AN ACCIDENT

No responsibility can be accepted by Brawview Motorhomes for any loss or damage or expense which occurs as a result of any accident.

Tell the police straight away if anyone is injured or there is a disagreement over who is responsible; and contact Brawview Motorhomes immediately.

Do not make any admission of liability nor give money to any injured person.

Obtain the name and address of any other driver and registration mark of any other vehicle involved.

Obtain Insurance Certificate from any driver You hold responsible for causing the accident and give such details to anyone that similarly holds you responsible (You are compelled to provide such information by the Road Traffic Act 1988).

Obtain the name and address of any witness.

Record the position in the road of your vehicle and any other vehicle involved.

If appropriate and safe to do so, take photographs.

Make the vehicle secure.

WINDSCREENS AND TYRES

You are responsible for any damage to windscreens and windows, punctures or other damage to tyres during the period of the hire. Where possible it should be repaired or replaced as appropriate with genuine manufacturers parts and paid for by you at the time. You should contact Brawview Motorhomes to seek instructions before carrying out the repair. Failing this, an amount will be deducted from your deposit against damages for the cost of the repairs.

DRIVERS

Only drivers who are authorised by Brawview Motorhomes and who have signed and completed a rental agreement/hirer proposal are permitted to drive the vehicle.

All drivers must have held a full UK/EU driving licence for at least two years.

Non-EU licences can be accepted subject to approval from our insurers.

Drivers must be aged between 25 and 79.

The following persons will be subject to approval by our insurer prior to driving the vehicle:

  • Persons with a physical impairment including: sight, hearing, heart condition, epilepsy, diabetes and any other condition that has caused blackouts or loss of control.
  • Persons who have had to make a health notification to the DVLA.

Drivers must not have more than 2 convictions with a maximum of 3 points per conviction on their licence.

Drivers must send a copy/scan of their driving licence to Brawview Motorhomes at least 14 days before the commencement of the hire, along with a DVLA check code that will be valid for the duration of the hire. https://www.gov.uk/view-driving-licence

Drivers must provide 2 forms of proof of address (utility bills, bank statements etc) at least 14 days before the commencement of hire.

All hirers/drivers must bring their valid driving licence with them on the day of collection to be checked.

Drivers must not have had their licence suspended for any period within the last 3 years.

Drivers must not have been involved in more than one fault accident in the last 3 years.

All fines and costs (including court costs) for speeding, parking or any other offences, congestion charges, (including any costs which arise if the vehicle is clamped). You must pay the appropriate authority any fines and costs, if, and when, the authority demands this payment. If you do not, you will be responsible to pay any costs and any reasonable administration charges which arise when Brawview Motorhomes deal with these matters.

Brawview Motorhomes reserves the right to refuse to hand over the motorhome to any person who, in our reasonable opinion, is not suitable to take charge of the motorhome. In such cases you will be refunded in full, but we will not have any further liability in relation to the aborted hire.

SEATBELTS

Our motorhome is fitted with three point seatbelts.  These are to be worn at all times when the vehicle is in motion.  Appropriate car seats must be used for children in accordance with the law.  It is the responsibility of the hirer to fit any child seats themselves.  Brawview Motorhomes take no responsibility for any ill fitted child restrains or seatbelts not being worn.

CAMPSITE BOOKINGS

It is the responsibility of the hirer to pre-book and confirm all caravan and campsites they intend to stay at during the holiday.  Brawview Motorhomes take no responsibility for any bookings or cancellations at caravan and campsites.

No responsibility shall be taken by Brawview Motorhomes for any loss or theft of personal property whilst in the motorhome.

PARKING

Parking is available free of charge for one vehicle however this is at the owner’s risk.

HOLIDAY INSURANCE

As with all holidays, Brawview Motorhomes request that you take your own holiday insurance.  Brawview Motorhomes accept no responsibility for loss or damage to your own personal belongings.

RETURN OF THE VEHICLE

  • The vehicle must be returned by the agreed time stated on the rental agreement.
  • The vehicle must be returned in a clean condition.
  • The toilet cassette must be empty.
  • The fuel tank must be full.

If the vehicle is returned in an unsatisfactory condition the following fees will apply:

Late return: £50 per hour will be charged for late returns.

Cleanliness: £25 per hour (up to £150).

Smoking: Smoking is strictly prohibited inside the motorhome. Any evidence of smoking inside the vehicle will incur a £250 charge.

Toilet: If the toilet cassette is not empty at time of return a £70 charge will be payable.

Fuel: If the vehicle is not returned with a full tank of fuel the hirer will be liable for the cost of filling up the tank at the advertised rates plus £25.

Gas: Two gas cylinders are supplied with each motorhome, one of which will be full, if more gas is required this is the responsibility of the hirer.  In any event both cylinders must be returned.
